Item for website?

I have someone wanting to pay me with an item for doing a website.
1. is it legal?
2. is there a safe way to go about doing it.

As far as I know, there's no taxes on bartering and it's not illegal from what I know. If it's something you're interested in having then treat it just as you would any cash transaction.

but like Peg says - there is no problems of legality (in general) with being paid "in kind"

So how do you guys go about getting your payment, do you do a certain ammount of the website, get payment, and finish, or?

well - mostly i'm salaried and out of the loop on client payments.

but when I pick up a freelance job, I negotiate a payment plan depending on what is actually involved.

A few tips:

If anything needs to be purchased on the client's behalf for the job, get a purchase order beforehand, and invoice them immediately after.

Set milestones - and delivery of each milestone in a project should be paid with an agreed portion of the full payment.

Set limits - specify that you will go through a limited number of major design rounds (usually 2 or 3), and specify what a 'major' change is. If they want a major/significant design or functionality change after that, then that's a new project with a new fee.

Also, be specific on what you will or won't do for the client - many of them think that web designers/developers are also copywriters and that you will provide content - if you don't want to do that, be very clear about it from the start.
