See... I have a website, on the Christian hard rock group, Payable On Death (POD). In the audio section I have 30 second clips of songs that I made and uploaded myself. I know it is illegal to post full MP3's, but I have little audio clips, and big links where you can click to buy the CD from CDnow.com.

Would this be a copyright problem? Thanks...

More than likely it would be a copyright infringement.

Most CD's have a statement somewhere in the liner notes that say "Unauthorized duplication and/or transmission is a violation of applicable laws".

However, if you could somehow get permission from the band or band's management, then it is a different story.

Yeah I see a lot of sites have clips,midi,mp3 and I'm not sure if they got permission to use them. I had midi's on my site but even with just them, I took them off after the Metallica incident.

I really don't see a problem with a small clip, but the WHOLE song is a different issue!

Check out this page. From what I can gather, it costs $264 per year to be able to use any song within the ASCAP library for use on the internet, plus a percentage of site revenue, and a percentage of fees that the web site user has to pya to access the information (monthly membership fees, one time fees).

I know I am going to keep it bookmarked for my own site.

well, unless they want to take some of my revenue,,, which is about 0 dollers a year... they can have it LOL.

I think that you can use up to 30 seconds on a clip, as I've seen it multiple places. I would also keep using them, as POD, being a Christian group, will most likely not get mad, although Atlantic might, if they bothered to check around for that. I'd still leave them on.

I don't get it. When there is a big ass link that says "IF YOU LIKE WHAT YOU HEAR, THEN PLEASE CLICK HERE TO BUY THE CD!!!" and with only 30 seconds you wouldn't think it's a problem.

Hmmm, to bad I'm actually selling CDs for them... geez

I agree. I don't think that it is much of a problem considering you aren't selling the clips or anything. I think the "Unauthorized duplication and reproduction" is more referring to generating revenue.

POD huh? My brother loves that group. I'm more of a dc TALK/Newsboys kinda' guy :).

Don't most record stores let you listen to a recording samples through headphones before buying? I don't see much difference.
