can i use images of britney spears on my fan site legally?

That depends on where you get the pictures. If you get them from a site that is "public domain", meaning that all content is free to take and do with what you want, then that is fine.
But if the pictures come from a "official" site, or one that prohibits reproduction of their content, then you can't use it.

Also be sure to make sure the source knows what they are talking about. Even a fan site is subject to copyright laws. There are many sites distributing material, that might not even be aware that it is copyrighted.

As long as you provide an e-mail contact address on your website, so that if anyone see's a picture that they own the copyright on, they can tell you.
Then you can immediatly remove it.
But if you use copyrighted pics, and give no contact, then I guess they could accuse you of deliberatlly trying to avoid being found out.
